These Terms & Conditions (“Terms”) govern your access to and use of the website located at www.mixartistry.com (the “Site”) and all courses, digital products, and services offered by SPL Mixing (Daniel Jason Booth trading as Mix Artistry) (ABN/ACN: 53 169 091 926), trading as Mix Artistry (“we”, “us”, “our”). By accessing or purchasing from the Site, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing this Site or making a purchase, you confirm that you are at least 18 years of age and have the legal capacity to enter into a binding contract. If you do not agree to these Terms, you must not use this Site or purchase our products.

2. Products and Services

Mix Artistry offers online educational courses and related digital products, including the Level Up Pro Mixing System and associated materials (collectively, “Course” or “Products”). All Products are delivered digitally via our Learning Management System (“LMS”), powered by LearnDash and hosted at www.mixartistry.com.

3. Digital Goods Delivery

Upon successful payment confirmation, you will be granted access to your purchased Course via your registered student account on the Site. Access is typically activated automatically within a few minutes of payment being processed. If you do not receive access within 24 hours, please contact us at admin@mixartistry.com with your order confirmation number.

Access is provided on a per-user, non-transferable basis. You may access the Course content through any device with a current web browser and internet connection. Mix Artistry makes no guarantee of uninterrupted or error-free access but will make reasonable efforts to restore access promptly in the event of technical failure.

In the event of a material technical failure that prevents access to substantial Course content for an extended period, and which is not resolved within a reasonable timeframe, you may be entitled to a remedy as described in our Refund Policy.

4. Pricing and Payment

All prices are displayed in AUD unless otherwise stated. Prices are subject to change without notice, though any change will not affect orders already placed and confirmed. Payment is processed securely through Stripe via SureCart. We do not store your payment card details on our servers.

5. Intellectual Property

All Course content — including but not limited to videos, audio recordings, written materials, worksheets, graphics, and software tools — is owned by or licensed to SPL Mixing (Daniel Jason Booth trading as Mix Artistry) / Mix Artistry and is protected by copyright, trademark, and other intellectual property laws.

Upon purchase, you are granted a limited, non-exclusive, non-transferable, personal licence to access and use the Course content for your own personal, non-commercial educational purposes only. You must not:

  • Share, distribute, resell, sublicence, or publicly display Course content in any form;
  • Copy, reproduce, or create derivative works from any Course material;
  • Use Course content for commercial training, coaching, or instructional purposes without express written consent from Mix Artistry.

Any unauthorised use of our intellectual property may result in immediate termination of your account and access, and may give rise to legal action.

6. Results Disclaimer

Mix Artistry provides educational content relating to audio mixing and music production. While we believe our Course content is of high quality and designed to build practical skills, we make no representations or guarantees regarding specific outcomes, including but not limited to:

  • Career advancement, job placement, or freelance income;
  • Specific improvements in mixing skill or the quality of any recording;
  • Any financial return on your investment in the Course.

Results depend on individual effort, prior experience, equipment, and factors outside our control. Testimonials and examples used on this Site represent exceptional results and are not intended to represent or guarantee that you will achieve the same or similar outcomes.

7. Refund Policy

Our refund terms are set out in full in our Refund Policy, which forms part of these Terms. Please read it before purchasing. Nothing in our Refund Policy affects your statutory rights under applicable consumer law (see Section 10 below).

8. Limitation of Liability

To the maximum extent permitted by applicable law, Mix Artistry and its directors, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our Products or Site, including but not limited to loss of data, loss of profits, or business interruption.

Our total liability to you for any claim arising in connection with these Terms shall not exceed the amount paid by you for the relevant Product in the 12 months preceding the claim.

9. Dispute Resolution

If you have a complaint or dispute, please contact us first at admin@mixartistry.com with a clear description of the issue. We aim to respond within 5 business days and resolve all disputes fairly and promptly.

If we are unable to resolve the dispute informally, it will be subject to the laws and courts of the jurisdiction specified in Section 10 below.

10. Governing Law and Consumer Rights

These Terms are governed by the laws of Victoria, Australia. You agree to submit to the non-exclusive jurisdiction of the courts of that state or territory for resolution of any disputes arising under these Terms.

Australian customers: Nothing in these Terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition implied or imposed by the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) that cannot lawfully be excluded or limited. Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law.

UK customers: If you are a consumer located in the United Kingdom, your rights under the Consumer Rights Act 2015 and other applicable UK consumer protection legislation are not affected by these Terms.

US customers: If you are located in the United States, nothing in these Terms limits any rights you have under applicable US federal or state consumer protection laws, including FTC regulations.

11. Modifications to These Terms

We reserve the right to modify these Terms at any time. When we do, we will update the “Last Updated” date at the top of this page. Continued use of the Site or your Course access following the posting of changes constitutes your acceptance of those changes. For material changes, we will make reasonable efforts to notify you via email or a notice on the Site.
